Mass General Brigham Incorporated and their owned-and-operated healthcare providers, as well as Dana-Farber Cancer Institute, Inc. (collectively, the “Defendants” as further defined herein), operate publicly accessible informational websites (such as www.massgeneralbrigham.org (previously www.partners.org), www.massgeneral.org, www.brighamandwomens.org, and www.dana-farber.org) (the “Informational Websites” as defined herein), which are available to the general public and do not require any login, username, or password to access. Website visitors do not need to create accounts or register. Additionally, they do not require them to show proof of their identity or self-identify. Informational Websites offer general information about the programs and offerings offered by the Defendants. They use third-party website analytics tools and pixels as well as related technologies.
Jane Doe (“the Doe Plaintiffs”) and John Doe (“the Doe Plaintiffs”) filed the lawsuit to make various legal claims for a hypothetical class of website visitors who were also patients. Plaintiffs allege that the Defendants did not obtain sufficient consent when placing third party analytics tools, cookies, and pixels on their general and publicly accessible websites, including, for example, massgeneralbrigham.org, massgeneral.org, brighamandwomens.org, and dana-farber.org. Plaintiffs claim that third-party analytics tools, pixels and cookies were used by the Defendants to place code on Informational Websites. This caused Plaintiffs’ web browsers to share information about Plaintiffs internet use with these Informational Websites.
How to find out if you’re in the settlement class
The Settlement Class is defined to be: “All persons who, during the Class Period, were patients of Defendants and visited Informational Websites. The Settlement Class does not include: (a), officers, directors and trustees of the Defendants;(b) all judges assigned to this case, their staffs, and any members their immediate families; (c), the mediator; (d), experts retained in this lawsuit by the Parties; and, (e) the Parties’ counsel in this litigation.
A Person is defined as a natural person living in the United States who is not an employee or a Defendant. The Class Period spans from May 23, 2016, to July 31, 2021. A patient is any person who has received medical treatment at any of Defendant health care providers during the Class period.
The Settlement provisions
In settlement, the defendants agreed to establish a Settlement Fund amounting $18.4million. The Settlement Fund will provide compensation for Settlement Class Members, pay notice costs and administration costs, pay any approved Service Awards for the Representative Plaintiffs, and also compensate attorneys for fees, costs and expenses. Settlement Class members will be prohibited from bringing further claims against the defendants and/or other parties in connection with any conduct related to third-party website analytics tools and pixels.
